Terms of Use
Effective date: 8 October 2026
These terms cover your use of ThimbleCare as an independent NDIS support worker. By creating an account, you agree to these terms. In these terms, "we" and "us" mean ThimbleCare. Participants, nominees and supporters use ThimbleCare under the Participant terms.
The service
ThimbleCare is web and phone software for sole trader support workers and the participants and families they support. It helps with notes, timesheets, agreements and invoices.
ThimbleCare is a tool. It is not an NDIS provider, plan manager or registered NDIS service. It gives no clinical, legal or tax advice. Using it does not replace your own professional judgement or NDIS obligations.
Your account
You must be 18 or older to create a worker account. Use ThimbleCare lawfully and for your own work as an independent support worker. Give us accurate account and business details, and keep them up to date.
Use your own account. Keep your password and sign-in details safe. Do not let another person act under your name. Email us promptly if you think someone has used your account without permission.
Your free trial
Your free trial lasts for 7 days from sign-up. You do not need a card to start it.
To keep using the worker features after the trial, choose a monthly subscription on the web. If you do not choose one, those features stop when the trial ends. Your account and records are not deleted when the trial ends, and the trial never turns into a payment by itself.
Participants, nominees and supporters never pay to use ThimbleCare.
Subscriptions and billing
Subscriptions are billed monthly in Australian dollars. Payments are made on the web, not in the phone app. Stripe processes the payments and holds your card details. We never see your full card number.
The founding price is $39 AUD per month while we offer it. The regular price is $59 AUD per month. If you subscribe at the founding price, you keep it until we give you notice of a change under "Price changes". Check the price and any tax shown before you agree to pay.
When you start a subscription, you authorise a charge each month at the price shown until you cancel. Keep your payment details current. If a payment fails, we will tell you what needs fixing, and we may pause the worker features until it is fixed.
Price changes
We may change the subscription price. We will email you at least 30 days before a new price applies to your subscription. The email will show the new price and the date it starts. A change does not affect a month you have already paid for. You can cancel before the new price starts.
Cancelling and your records
You can cancel at any time. To cancel, email hello@thimblecare.com from your account email address. There is no self-serve cancellation option yet. We will confirm your cancellation and the date your paid access ends.
Cancelling stops future charges. You keep paid access until the end of the month you have paid for.
Cancelling does not automatically delete your account or records. Save copies of the records you need before you leave. To close your account, use "Close account" in Settings or email us. Email us if you need help getting a copy.
You are responsible for keeping the business and support records your work requires. We may need to keep some information to meet legal obligations or deal with disputes. Email us to ask what will be kept, or to request access, correction or deletion. We will explain any reason we cannot delete information. We do not promise to keep your records available forever after your account closes.
Refunds and your consumer rights
We do not refund part of a month when you cancel, unless the law requires it. Email us if a charge looks wrong or you want to ask for a refund. We will consider your request and give any refund or other remedy the Australian Consumer Law requires.
Nothing in these terms excludes, restricts or changes rights or consumer guarantees that cannot lawfully be excluded. This includes your right to a remedy when the service does not meet a consumer guarantee. Cancelling does not take away those rights.
Acceptable use
Use ThimbleCare lawfully and with respect for other people. Do not:
- upload information you have no right to use or share;
- create false or misleading notes, timesheets, approvals or invoices;
- harass people or upload abusive or unlawful material;
- try to access another person's account or information without permission;
- interfere with the service, get around its safeguards or upload harmful software.
Your responsibilities as a worker
You are responsible for the accuracy and completeness of your notes, timesheets, agreements and invoices. Check them before you submit, sign or send them. Correct errors through the correction steps in ThimbleCare, or ask us for help.
You are responsible for your own NDIS obligations, qualifications, screening checks, insurance, business records and tax. Check the rules that apply to your work and the supports you provide. ThimbleCare does not decide whether a support is appropriate, an invoice is claimable or your work meets those rules.
Your agreement with a participant is separate from these terms. You remain responsible for the support you provide and for handling concerns about that support.
Participant information and privacy
Only enter or share participant information when you have the authority to do so. Explain your use of ThimbleCare to the participant or the person authorised to act for them. Respect their choices and the access allowed for each nominee or supporter.
Your ThimbleCare records are stored in Australia. You keep your rights in the information you enter. You allow us to store, process and show it only as needed to provide the service to you and the people you share it with. This does not give us ownership of your records.
Read our Privacy Policy. Email us to ask about how account or participant information is handled, or to request access, correction or deletion.
Our software
ThimbleCare owns the software and its design, other than the information you and the people you work with enter. You may use the software only as these terms allow. Do not copy, resell or take apart the software.
Availability and changes to the service
We aim to keep ThimbleCare available, but maintenance, faults or events outside our reasonable control may interrupt it. Keep copies of important records and a way to manage your work during an interruption.
We may improve, change or retire features. We will give reasonable notice of changes that materially affect your use where we can. Your rights under the Australian Consumer Law still apply.
Suspension and termination
We may suspend or close an account for serious or repeated breaches of these terms, unpaid subscription charges, unlawful use or a risk to people's information or the service.
Where practical, we will explain the reason and give you a reasonable chance to fix the issue. We may act immediately if needed to protect people or information, or to comply with the law. You can email us to ask for a review.
We will explain what happens to your subscription and records when access ends. Where lawful and safe, we will give you a reasonable chance to request a copy of your records. Any refund or other remedy required by law still applies.
Liability
We will provide the service with due care and skill. Nothing in these terms limits liability that the law does not allow us to limit, including under the Australian Consumer Law and its consumer guarantees.
As far as the law allows:
- we are not liable for indirect loss, lost profits or lost business opportunities arising from use of the service;
- we are not responsible for loss caused by inaccurate information you enter, your misuse of the service or events outside our reasonable control;
- our total liability to you is limited to the subscription fees you paid us in the 12 months before the claim.
Where a consumer guarantee applies and the law lets us limit our liability for a failure to meet it, our liability is limited to supplying the service again or paying the cost of having it supplied again.
Changes to these terms
We may update these terms as the service changes. We will publish the updated terms here with a new effective date. For a change that materially affects you, we will email you at least 30 days before it takes effect, unless the law or an urgent safety or security need requires an earlier change.
If you do not accept a change, you can cancel before it takes effect. Changes do not remove rights you already have under the law.
Governing law
These terms are governed by the laws of New South Wales, Australia. This does not take away any rights you have under the Australian Consumer Law or other laws that cannot be excluded.
